Terms of Service
These Terms of Service ("Terms") govern your use of the Tell Your Sons website and mobile application (together, the "Service"), operated by One Culture LLC ("we," "us," or "our"), a limited liability company based in Tennessee. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Tell Your Sons is a Bible reading app built around a one-year reading plan: one passage a day, Genesis to Revelation. We may add, change, or remove features at any time as we improve the Service.
2. Eligibility and Accounts
You must be at least 13 years old to use the Service. If you create an account, you are responsible for keeping your credentials secure and for all activity that occurs under your account. Provide accurate information and keep it up to date.
3. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You may not:
- Copy, modify, distribute, sell, or lease any part of the Service;
- Reverse engineer or attempt to extract the source code of the Service;
- Use the Service in any way that violates applicable law;
- Interfere with or disrupt the Service or its infrastructure.
4. Purchases and Subscriptions
Some features of the Service may be offered for purchase or by subscription through the Apple App Store or Google Play. Billing, renewal, and cancellation are handled by the applicable app store under its terms. Except where required by law or expressly stated otherwise, purchases are non-refundable.
5. Intellectual Property
The Service, including its design, text, graphics, logos, and software, is owned by One Culture LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. "Tell Your Sons" and the associated marks are trademarks of One Culture LLC. Scripture text is used in accordance with its applicable licensing.
6. Acceptable Use
You agree to use the Service honestly and lawfully. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, the Service, or other users.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the fullest extent permitted by law, One Culture LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred dollars ($100).
9. Indemnification
You agree to indemnify and hold harmless One Culture LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
11. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Tennessee, and you consent to the jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
