Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and One Culture LLC ("we," "us," or "our"), a limited liability company based in Tennessee, and govern your use of the Tell Your Sons website and the Tell Your Sons mobile application for iOS and Android (together, the "Service"). These Terms also serve as the end user license agreement ("EULA") for the mobile application. By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Tell Your Sons is a Bible reading app built around a one-year reading plan: one passage a day, Genesis to Revelation, along with shorter topical reading paths. We may add, change, or remove features at any time as we improve the Service.
2. Eligibility and Accounts
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or guardian. If you create an account, you are responsible for keeping your credentials secure and for all activity that occurs under your account. Provide accurate information and keep it up to date.
You may delete your account at any time from within the app (Settings → Account → Delete Account) or by emailing info@tellyoursons.com. Deleting your account permanently removes your reading progress and saved content, as described in our Privacy Policy.
3. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on devices you own or control, for your personal, non-commercial use, subject to these Terms and to the usage rules set forth in the Apple App Store Terms of Service or Google Play Terms of Service, as applicable. You may not:
- Copy, modify, distribute, sell, rent, lease, or sublicense any part of the Service;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits;
- Remove or alter any copyright, trademark, or other proprietary notices;
- Use the Service in any way that violates applicable law;
- Use automated means to access, scrape, or extract content from the Service;
- Interfere with or disrupt the Service or its infrastructure.
4. Purchases, Subscriptions, and Free Trials
Some features of the Service are offered for a one-time purchase or by auto-renewing subscription, purchased through the Apple App Store or Google Play (each an "App Store"). The price, billing period, and any free trial will be shown to you before you confirm a purchase.
- Payment. Payment is charged to the App Store account you used to make the purchase at confirmation of purchase. We do not collect or store your payment card details.
- Automatic renewal. Subscriptions automatically renew at the end of each billing period at the then-current price for your plan, unless you cancel at least 24 hours before the end of the current period. Your App Store account will be charged for renewal within 24 hours prior to the end of the current period.
- Managing and cancelling. You can manage or cancel your subscription at any time in your App Store account settings: on iOS, open Settings, tap your name, then Subscriptions; on Android, open the Google Play app, tap your profile, then Payments & subscriptions. Cancellation takes effect at the end of the current billing period, and you keep access until then. Deleting the app or your Tell Your Sons account does not cancel your subscription.
- Free trials. If a free trial is offered, you will be charged when the trial ends unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Price changes. If we change the price of a subscription, the App Store will notify you in advance as required by its rules, and the new price will apply to your next renewal unless you cancel.
- Refunds. Purchases are processed by the App Store, and refunds are governed by the App Store's policies. If you believe you are entitled to a refund, please request it through Apple or Google. Except where required by law, we are not able to issue refunds directly.
5. Your Content
If the Service allows you to save notes, highlights, or other content ("Your Content"), you retain ownership of it. You grant us a limited license to store, back up, sync, and display Your Content solely for the purpose of providing the Service to you. You are responsible for Your Content and for having the right to save it.
6. Intellectual Property
The Service, including its design, text, graphics, logos, reading plans, and software, is owned by One Culture LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. "Tell Your Sons" and the associated marks are trademarks of One Culture LLC. Scripture text is used in accordance with the license of the applicable copyright holder, and copyright notices for Scripture translations are provided within the Service. Nothing in these Terms grants you any right to use our trademarks or the Scripture text outside the Service.
7. Acceptable Use
You agree to use the Service honestly and lawfully. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, the Service, or other users.
8. Third-Party Services
The Service relies on third-party services such as the App Stores, sign-in providers, and cloud infrastructure, and may contain links to third-party websites or resources. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their own terms.
9. Apple App Store Terms
If you downloaded the Service from the Apple App Store, the following additional terms apply:
- These Terms are an agreement between you and One Culture LLC only, and not with Apple Inc. ("Apple"). One Culture LLC, not Apple, is solely responsible for the Service and its content.
- Your license to the Service is limited to a non-transferable license to use the Service on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Service may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- One Culture LLC, not Apple, is solely responsible for providing any maintenance and support for the Service. Apple has no obligation whatsoever to furnish any maintenance or support services for the Service.
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the sole responsibility of One Culture LLC.
- One Culture LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession or use of it, including (i) product liability claims, (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, One Culture LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the Service.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
The Service offers Scripture and reading plans for spiritual encouragement. It is not a substitute for professional medical, mental health, legal, or financial advice. If you are in crisis or need help, please contact a qualified professional or your local emergency services.
11. Limitation of Liability
To the fullest extent permitted by law, One Culture LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless One Culture LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.
13. Termination
You may stop using the Service at any time and may delete your account as described in Section 2. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
14. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Tennessee, and you consent to the jurisdiction of those courts. If you are a consumer in a jurisdiction whose law gives you mandatory protections, nothing in this section deprives you of those protections.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
